The Sixth Circuit recently upheld judgment for an employee on her claim that Honda failed to timely restore her to work after her FMLA leave. USERRA Provides No Right to “Rest Period” Between Conclusion of Military Exercises and Return to Work

In a case of first impression, the U.S. Court of Appeals for the Third Circuit recently ruled that the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA) does not require an employer to provide an eight hour “rest period” between the completion of military duty and an employee’s return to work. Barring a Public School Teacher’s Participation in a Religious Club Held to Violate the First Amendment

The Eighth Circuit recently held that a public school’s policy prohibiting a teacher from participating in a religious group meeting on school property immediately after the school day ended violated the teacher’s First Amendment rights. Read More
