of the Essence: Job Restoration Under the FMLA
The Sixth
Circuit recently upheld judgment for an employee on her claim that Honda
failed to timely restore her to work after her FMLA leave. The court found
that Honda’s failure to return the employee to work until 34 days
after she attempted (and was able) to return to work violated the FMLA.

Provides No Right to “Rest Period” Between Conclusion of Military
Exercises and Return to Work
In a case
of first impression, the U.S. Court of Appeals for the Third Circuit recently
ruled that the Uniformed Services Employment and Reemployment Rights Act
of 1994 (USERRA) does not require an employer to provide an eight hour
“rest period” between the completion of military duty and

to Violate the First Amendment

Circuit recently held that a public school’s policy prohibiting
